Posts: 11747 11/30/10 01:37:22	the play is obvious - they are playing the long game. because they know once FB is out of the picture, they are back in town. this tax thing can be avoided by simply not producing above 3.5 million litres per month - the balance you produce in NZ. they just shift the weight to their NZ operations and balance it out. so they move their production capacity south to NZ the only guys who lose here is FB's govt - they don't get any money out of this fiasco - and they end up losing export numbers. our water exports go down AND we don't get that projected $22 million in taxes. full stop. this is a smart play by the Fiji Water guys. they MOVE the WEIGHT of their production to NZ, but they retain a token presence here and bide their time. they lose nothing. NZ gains from this transition - NZ's water exports go up because Fiji Water will make up for the Fiji shortfall from there. smart very smart the only losers here is FB's govt and 2011 budget Last Edited By: real jack 11/30/10 01:45:03. Posts: 11749 11/30/10 03:14:56	personally i thought that move of closing down the factory yesterday was a rash move - i understand that they probably felt they had to do that - but i thought they would have played it smoother and with a little bit more finnese. if they had cooler heads over there, they would have managed a smooth drama free transition with this play i've just set out above - no drama. just nice and smooth. with stakes like that its always about the end game - every stage is just a step. if they are are switched on, they are five or six steps ahead of the pack - and every move they make is smooth. nice and smooth. quiet and efficient. And I think the management of Fiji Water know they have been fleecing Fiji for a while now. It could only take the likes of FB to bring them to account. These things need to be done by force. Fiji Water certainly cannot bribe its way of of this one.....like it has been doing with the likes of the crooks in the SDL at the expense of the people of Fiji.

Posts: 11750 11/30/10 03:37:44	what we achieved is a phyrric victory xtali to pay that tax they need to produce 3.5 million litres per month. so what this effectively means is that to AVOID paying that tax - which they have clearly stated they cannot afford, they will NOT produce 3.5 million litres per month what that means is that out water production COMES DOWN and our water exports COMES DOWN. these guys exported $130 million worth of water last year - they do close to 60 million litres of water which is about 5 million litres a month. which means that they will have to come down to 40 million litres of water a year to get under that 3.5 million litres per month. thats a drop of 20 million litres. possibly more. that 20 million litres will have to come from somewhere - because they will need to meet their distribution agreements - and that somewhere is their acquifer in New Zealand. what this means put very simply is (a) we have a drop in our water exports - meaning less money coming to Fiji; and (b) the Govt doesn't get its hands on that 22 million in taxes it was planning to get out of that tax. there is no win win. Fiji Water wins. FB govt loses.

And what kind of mentality in the Indian community thought that they could persecute Fijians, decree away the chiefly system, put itaukei land in a land bank scam, and get away with it? Very cunning road to nowhere. First no extensions to leases, then no restructuring help from the EU, then scam machinery and installation from India, and now promises of subsidized help from a bankrupt government which depends for its existance on feeding the military. What do they need cane farmers for? That question is too deep for them.

They wont get the same tax holidays that they have had in Fiji. 0.3C/litre tax was crazy in the first place. The Govt should have phased in any tax increases over time and depending on volumes.

I don't believe Fiji Water will produce less to avoid going over the threshold. I am an accountant and I tell all my clients paying tax is good...means you are making money. If they don't pay tax in Fiji, you think they won't pay tax anywhere else?? Where are they gonna hide?? Like the old saying goes "the two certainties of life...death and taxes". "Fiji Water" the brand is now bigger than the people who make it. They will pay the tax in Fiji......its the law. They are going no where.

I don't see Australians scrambling to earn $37k or less to stay within the 15% tax bracket!!!!! Jack, you seem to be suggesting that is what Fiji Water will do to stay under the threshold and they will fill the rest of their orders from NZ.......what by branding NZ water with the Fiji Water label?? I don't think they are that foolish. If they damage the brand name it certainly will not be Frank's fault. If anything happens to Fiji Water the only people to blame will be the management of Fiji Water and its advisors...no one else. I think their 'smart ayrse' tactic lasted all of 24 hours before some sense prevailed.

Lets go with Jacks premise that now they are exporting 60 million gallons and that they would now export 40 million gallons. Normally that would be a third less of their income. Then take the avoidance of paying 14.7 cents per liter... and they probability that they would raise their prices slightly say 5.3 cents a liter rounding it off to 20 cents gained by reducing production. What would be the total percentage they would lose??? Depending on those figures, their ability to wait out this Govt, or renogatiate the bump in taxes and a few other irons they have in the fire, then one would know if it was worth it to them. Either way this Govt did not make the wisest move, they did not generate more income, but they did generate more neagative press. Personally, I think Fiji Water could pay slightly more that 1/3 a cent per liter. But then again Govt. shouldn't change the rules in the middle of the game either if they want to inspire investors confidence, because right now the image they are portraying is that I am sure they don't want to portray is if you are successful you will be singled out.
